Cardinal Health Head Compliance Germany, Austria & Switzerland in Norderstedt Sudportal, Germany

THE POSITION

The Head of Compliance will support the Director Compliance Europe and the VP of Compliance to enhance compliance program execution and risk management in the European German speaking Countries. In addition, the person will support the Director Compliance Europe to carry out monitoring activities, audits, trainings and forensic investigations across Europe.

RESPONSIBILITIES and ACCOUNTABILITES

  • Perform autonomous compliance monitoring of business activities, medical events and Interactions with Healthcare Professionals (“HCP”), Healthcare Organizations (“HCO”), Non-Clinical Stakeholders and Governmental Officials in general, both locally and cross-border;
  • Manage the evaluation of all activities that require compliance pre-approval before payment, ensure process transparency, documentation completeness and archiving;
  • Supporting in the integration of Cardinal Health acquisitions and the development of regional business operations for Cardinal Health in EMEA;
  • Contribute in ensuring the delivering of EMEA and local compliance procedures to support the business from a compliance perspective;
  • Deliver, monitor and ensure the training on compliance procedures, both for employees and third parties, when applicable;
  • Support the legal entities to be compliant with the local and international anti-corruption laws;
  • Support investigations on compliance concerns raised by management, employees or others;
  • Ensures compliance with regulations and controls by examining and analyzing records, reports, operating practices and documentation;
  • Recommend opportunities to strengthen the internal control structure;
  • Support the business in the Due Diligence process on Third Parties intermediaries;
  • Support the Personal Data Responsible in training and monitoring of the documents retention;
  • Attend and present during the Cluster/ Local Board meetings, the Compliance Committee and any other Committee where is one of the member;
  • Record retention for EMEA Legal & Compliance;
  • Be an effective member in EMEA or Global projects when requested;
  • Audit of accounting and other records for the purpose of compliance audit with focus on key compliance risk areas, including:

  • Payments to HCP and fair market value

  • Payment to Non Clinical Stakeholders and Government Officials in general
  • Local medical events
  • Grants, sponsorship, donation and charitable contribution
  • Fees to hospitals

  • Transactions with HCO and medical associations

  • Distributor and third party intermediaries due diligence
  • Employee expense reports

Internal Clients/Relationship:

  • Frequent and significant, including the colleagues from the Legal Function, corporate functional leadership, EMEA senior management and EMEA employees, across all functions

External Clients/Relationship:

  • Occasional interaction with professional service providers and Government Officials and potentially with key customers/distributors, principals;
  • Build the relationship with the local Trade Associations;

Additional responsibilities:

  • Ensure the coordination of the records retention process for the EMEA Compliance department

QUALIFICATIONS

  • Years of Work Experience: 6 years minimum
  • Familiarity with the medical device industry, laws and regulations governing medical device manufacturers, and healthcare compliance
  • Preferred Training/Technical Knowledge: Forensic auditing/investigation training, including technology use.
  • Experience working for US-based company
  • Required Language Skills: Verbal and written: German and English
  • Flexibility to Travel: 10 to 30%
